Terms of Service
Last updated: November 6, 2026 (version 2026-11-06)
Agreement
These Terms of Service (“Terms”) are a legal agreement between you and FoodFindr (“FoodFindr,” “we,” “us”). They apply whenever you use the FoodFindr app, the website at getfoodfindr.com (including the live map), or any related service (together, the “Service”), whether or not you have an account. By using the Service, creating an account, or tapping “I agree,” you accept these Terms, our Privacy Policy, and our Community Guidelines. If you do not agree, do not use the Service.
Please read the “Disputes, arbitration, and class-action waiver” section carefully. It requires most disputes to be resolved by individual arbitration instead of in court or as part of a class action, unless you opt out.
Who can use FoodFindr
You must be at least 13 years old to use the Service. If you are under 18, you may use it only with the permission and supervision of a parent or legal guardian, who agrees to these Terms for you. You must be at least 18 years old to sell, publish a vendor profile, go live, or share a vendor location. You may not use the Service if you have been suspended or banned, or if the law prohibits you from using it.
You are responsible for your account, for keeping your sign-in details secure, and for everything that happens under your account. Give accurate information and keep it up to date.
What FoodFindr is, and isn't
FoodFindr is an information and discovery tool. It shows listings, locations, schedules, menus, photos, and messages that vendors and other users provide. Vendors are independent third parties. They are not FoodFindr’s employees, agents, partners, or contractors, and FoodFindr does not control them.
FoodFindr does not prepare, sell, handle, deliver, inspect, or approve any food or goods. FoodFindr does not check or verify any vendor’s identity, licenses, permits, insurance, food-safety practices, hygiene, ingredients, allergens, prices, or compliance with any law, and a “verified” label or other badge does not mean otherwise. Any purchase or interaction is solely between you and the vendor or other user.
No guarantees
Everything on the Service may be wrong, incomplete, out of date, or unavailable, and you use it at your own risk. FoodFindr makes no promise that any vendor is open, live, at the location or time shown, or selling what is listed. This includes live pins, planned spots, weekly schedules, hours, end times, menus, prices, photos, distances, directions, alerts and notifications, community reports, and confidence signals. A vendor may move, close early, run out, or not show up at all. Notifications may be late or may not arrive.
FoodFindr may change, suspend, limit, or end any part of the Service at any time, for any reason, without notice and without liability to you. The Service may have errors, outages, or data loss.
Your safety and your choices
You are solely responsible for your own decisions and safety, including what you eat or buy, whether you travel to a location, and how you interact with vendors and other people. Food from street vendors and other sellers may carry risks, including foodborne illness and allergens. Ask the vendor about ingredients and preparation, and use your own judgment. Follow traffic laws and stay aware of your surroundings; don’t use the app while driving. To the fullest extent the law allows, you assume all risks arising from your use of the Service and from any food, purchase, trip, meeting, or interaction connected with it.
Zero tolerance for objectionable content and abusive users
FoodFindr has zero tolerance for objectionable content or abusive users. You may not post, share, or send content that is:
- harassing, bullying, threatening, or hateful toward any person or group
- sexually explicit, violent, or graphic
- defamatory, discriminatory, or meant to intimidate
- spam, scams, fraud, or misleading listings, photos, schedules, and reports
- illegal, or promotes illegal goods or activity
- someone else’s private information or content you don’t have the right to share
You also may not harass sellers or shoppers, evade a block, impersonate another person or vendor, manipulate reports, alerts, or confidence signals, scrape or copy the Service by automated means, interfere with its security or operation, or use it for anything unlawful.
Reporting, blocking, and enforcement
You can report posts, stories, messages, listings, photos, and vendors from their menu in the app, and you can block any account or vendor. You can also email abuse@getfoodfindr.com. We aim to act on reports within 24 hours.
We may remove any content and suspend, limit, or end any account at any time, with or without a report, notice, or explanation, if we believe it is appropriate. We are not obligated to monitor, review, or remove content, and we are not responsible for content or conduct of users or vendors.
Your content
You keep ownership of the photos, videos, captions, menus, schedules, messages, and other content you add (“Your Content”). You give FoodFindr a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, copy, display, adapt (for example, to resize or format), and distribute Your Content to operate, improve, and promote the Service, including in links you share and on getfoodfindr.com. This license continues for content others have already shared or saved, and as needed for backups, legal, and safety purposes.
You are solely responsible for Your Content and confirm you have all rights needed to share it, and that it does not violate these Terms or anyone’s rights. Content you post publicly, including your vendor profile, menu, schedule, live location, and planned spot, can be seen by anyone, including people without an account.
Seller responsibilities
If you sell, publish a vendor profile, or go live, you are solely responsible for your business and everything you sell. This includes food safety, ingredients and allergen information, pricing, payment collection, refunds, taxes, permits, licenses, insurance, and following all applicable laws. Keep your listing, menu, prices, hours, and schedule accurate.
You choose when and where to share your location, including any live pin and any planned spot you show before going live. Share only places where you are comfortable being found, and only places you have the right to sell from. You do so at your own risk.
No checkout or payment processing
FoodFindr is free to use. FoodFindr does not process payments, hold funds, act as the merchant of record, set prices, or issue refunds. Payments, refunds, and any disputes about a purchase are solely between buyers and sellers.
Third-party services
The Service relies on and links to services run by others, such as maps, directions, app stores, sign-in, hosting, and notifications. FoodFindr does not control and is not responsible for them, and your use of them is governed by their own terms.
Disclaimer of warranties
THE SERVICE AND ALL CONTENT ON IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, FOODFINDR DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE. FOODFINDR DOES NOT WARRANT THAT THE SERVICE WILL BE ACCURATE, RELIABLE, SECURE, ERROR-FREE, OR UNINTERRUPTED, OR THAT ANY VENDOR, FOOD, OR GOODS WILL BE SAFE, LAWFUL, AVAILABLE, OR AS DESCRIBED.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FOODFINDR AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, OR FOR ANY PERSONAL INJURY, ILLNESS, OR PROPERTY DAMAGE, ARISING FROM OR RELATED TO THE SERVICE, ANY VENDOR OR USER, ANY FOOD OR GOODS, ANY CONTENT, OR ANY TRIP, MEETING, OR TRANSACTION, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF FOODFINDR WAS ADVISED OF THE POSSIBILITY.
FOODFINDR’S TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF FIFTY U.S. DOLLARS (US$50) OR THE AMOUNT YOU PAID FOODFINDR IN THE 12 MONTHS BEFORE THE CLAIM.
Some places do not allow certain exclusions or limits, so some of the above may not apply to you. In that case, these limits apply to the fullest extent allowed.
Indemnification
You agree to defend, indemnify, and hold harmless FoodFindr and its owners, officers, employees, contractors, and agents from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from Your Content, your use of the Service, your sales or business if you are a seller, your interactions with others, or your violation of these Terms or any law or anyone’s rights.
Release
Disputes with vendors or other users are between you and them. To the fullest extent the law allows, you release FoodFindr and its owners, officers, employees, contractors, and agents from all claims, demands, and damages of every kind, known and unknown, arising from or connected with any such dispute, and from any food, goods, trip, meeting, or transaction. If you are a California resident, you waive California Civil Code § 1542, which says: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.” You waive any similar law elsewhere.
Disputes, arbitration, and class-action waiver
Talk to us first. Before filing any claim, you agree to email legal@getfoodfindr.com with a description of the dispute and give us 60 days to try to resolve it informally.
Binding individual arbitration. If we can’t resolve it, you and FoodFindr agree that any dispute, claim, or controversy arising from or relating to these Terms or the Service will be resolved by final, binding arbitration on an individual basis, administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitrator decides all issues, including whether a claim must be arbitrated, except that a court decides the class-action waiver below. Either party may instead bring an individual claim in small-claims court if it qualifies, or seek a court order to stop infringement or misuse of intellectual property.
No class actions. YOU AND FOODFINDR EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION OR ARBITRATION. Claims may be brought only individually. If this waiver is found unenforceable for a claim, that claim must be decided in court, not arbitration.
Opting out. You may opt out of this arbitration agreement by emailing legal@getfoodfindr.com within 30 days after you first accept these Terms, with your name, the email or phone on your account, and a clear statement that you opt out of arbitration. Opting out does not affect the rest of these Terms.
Time limit. To the extent the law allows, any claim must be filed within one year after it arises, or it is permanently barred.
Governing law and venue
These Terms are governed by the laws of the State of Arizona and applicable U.S. federal law, including the Federal Arbitration Act, without regard to conflict-of-law rules. For any claim not subject to arbitration, you and FoodFindr agree to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona.
Ending your account
You can stop using the Service at any time and delete your account from Settings in the app or at getfoodfindr.com/delete-account. We may suspend or end your access at any time, for any reason, without notice. Sections that by their nature should survive, including those on your content license, no guarantees, disclaimers, limitation of liability, indemnification, release, and disputes, survive after your account ends.
Apple App Store users
If you got FoodFindr from the Apple App Store: these Terms are between you and FoodFindr only, not Apple, and FoodFindr, not Apple, is responsible for the app and its content. Your license to use the app is limited to Apple-branded devices you own or control, as allowed by the App Store Terms of Service. Apple has no obligation to provide maintenance or support for the app. To the extent any warranty applies by law and the app fails to meet it, you may notify Apple, and Apple will refund any purchase price (the app is free); to the maximum extent the law allows, Apple has no other warranty obligation. FoodFindr, not Apple, is responsible for any claims relating to the app, including product liability, legal or regulatory compliance, consumer protection, and intellectual property claims. You confirm that you are not in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Apple’s standard Licensed Application End User License Agreement also applies where these Terms don’t address something.
General
These Terms, the Privacy Policy, and the Community Guidelines are the entire agreement between you and FoodFindr about the Service. If any part of these Terms is found unenforceable, it will be enforced to the maximum extent possible and the rest stays in effect. Our failure to enforce any part is not a waiver. You may not transfer these Terms; we may transfer them, for example in a sale or reorganization. FoodFindr is not liable for delays or failures caused by events beyond its reasonable control. Headings are for convenience only.
Changes and contact
We may update these Terms at any time. If a change is meaningful, the app will ask you to agree again, and continuing to use the Service after an update means you accept it. For legal notices or questions, contact legal@getfoodfindr.com.
